General Terms and Conditions of Participation for Instagram Contests by DUŠA & KAMEN, a brand of Fitness für Mamas GmbH – hereinafter referred to as the "Organizer".

Scope of application/Exception of Instagram

These terms and conditions apply to all competitions conducted via Instagram at www.instagram.com/dusaandkamen/. Only the Instagram profile name will be recorded by the organizer.

The sweepstakes conducted via our Instagram profile are not affiliated with Facebook, Inc. or Facebook Ireland Ltd. The sweepstakes are not sponsored, endorsed, or organized by Instagram in any way and do not create any legal claim against Instagram. All information in the sweepstakes is provided exclusively by the organizer .

Section 1 Eligible Participants / Participation

By participating in the competition, the Instagram user expressly accepts these general terms and conditions. The minimum age for participation is 18 years. Employees of the organizer and its affiliated companies or partners involved in the competition are excluded from participation. The same applies to their relatives or partners. Participation is only possible via a personal Instagram account.

If the organizer becomes aware of any technical manipulation or other violation of these terms and conditions, they will exclude the participant from the competition. Technical manipulations include, but are not limited to, multiple registrations by one person, participation via a sweepstakes service or similar automated group participation services.

In these cases, the prize can be revoked retroactively and a replacement winner can be drawn. The contest begins with the respective publication date on our Instagram page. Participation is only possible until the specified date of the draw.

Depending on the competition, participation is possible, for example, by liking a post on our Instagram page, commenting on it, or writing a message to the organizer as the operator of the Instagram page.

In the event of a violation of these rules, the participant must expressly assume responsibility for any legal violations. To this extent, the participant fully indemnifies the organizer from all claims of third parties, including the necessary costs of legal defense and prosecution.

Section 2 Determination of Profit/Determination of Profit Amount/Liability

The prize is stated in the respective competition post. Prizes awarded are goods and services with a retail value not exceeding €2000. A cash payout or exchange of the prize is not possible.

The prize claim is non-transferable.

Determination/Acceptance of the price:

In the case of participation, the winner will be determined by uploading a photo/image or by entering text, usually by drawing lots, unless Instagram has made other statements regarding the determination of the prize, e.g. – The photo with the most "likes" wins (voting among users).

If it is not necessary to post your own content in order to participate, but participation only consists of, for example, "liking" a post or answering a question, the principle of randomness decides.

The winners will be determined immediately after the end of the contest and notified via Instagram.

The winner must confirm acceptance of the prize within the period specified in the notification of the win. We usually deliver the prize by post or email.

In the event of notification, the winner must therefore provide their complete contact details, including postal address and email address. If the prize is not delivered but can be picked up on site, this will be stated separately in the notification.

Participants are responsible for adhering to the opening and visiting hours of the facilities. The organizers expressly reserve the right to make changes to individual services in the event program. Legal recourse is excluded.

Section 3 Liability

If the prize is offered by a third party, the organizer of the competition is not liable for any non-performance or poor performance of the prize or for any damage incurred by the winner in connection with the use of the prize.

The organizer of the competition is only liable for damages in connection with the competition that were caused intentionally or through gross negligence by its own employees or other vicarious agents.

Section 4 Data Protection

As part of the competition, personal data of the winners and any accompanying persons will be collected. We need this data to process the competition. For this purpose, the surname and first name, postal address and e-mail address of the persons concerned will be collected, stored and used.

In the event of a win, the organizer is also entitled to publish the winner's Instagram profile picture and name (also outside of Instagram, for example on our website).

By participating in the competition, the participant accepts the privacy policy of DUŠA & KAMEN.

Section 5 Early Termination of the Contest

The organizer reserves the right to change, cancel, or terminate the contest without prior notice regarding the elements of the contest due to unforeseen circumstances. This applies if software and/or hardware errors occur and/or other technical and/or legal reasons affect or make the proper conduct of the contest impossible.

Section 6 Miscellaneous

The competition is governed exclusively by the law of the Federal Republic of Germany.

Should one or more of the foregoing clauses be or become wholly or partially void, invalid or unenforceable, the remaining conditions shall remain valid. A corresponding, valid clause shall be substituted in their place. The same applies in the case of a gap in the regulations.
